I don't believe that people should be required by law to recycle, and punished if they do not. Of course, recycling is great for the environment and the planet, but it is not always possible for everybody to do. For example, people who live in urban areas may not have recycling pick-up, and perhaps they can't afford to drive into a town every week to drop off their recycling. To fine or jail people who don't have the ability to constantly recycle would be unethical. However, if all people had equal access to recycling facilities, I would argue that recycling should be required by law. Unfortunately, this is not currently the case.
