EPP SENTENÇA 1 RELATÓRIO O trabalhador Jorge dos Anjos ajuizou a reclamação trabalhista (nº do processo) em face da Lanchonete Dois Irmãos LTDA. EPP., alegando que foi contratado em 4/12/2017 e laborado até 28/6/2019, seu último dia de cumprimento do aviso prévio trabalhadoAlega que foi contratado para exercer as funções de atendente, auferindo remuneração mensal de R$ 1.500,00 (mil e quinhentos reais), com uma jornada das 8h às 13h15min, de segunda a sexta- feira. Todavia, alega que estendia sua jornada, em média, 1 (uma) hora por dia, terminando o expediente sempre às 14h15min, não tendo recebido qualquer valor pelo labor extraordinário. Afirma, ainda, que tinha que chegar na reclamada com 15 (quinze) minutos de antecedência para se uniformizar, período este que também não era remunerado. Diante do elastecimento da jornada pelas horas extras prestadas, ou seja, por ser superior a 6 (seis) horas diárias, assevera que tinha direito a intervalo intrajornada de 1 (uma) hora, mas que lhe eram concedidos somente 15 (quinze) minutos. Por fim, o trabalhador destaca que recebia mensalmente uma parcela denominada “prêmio”, no valor de R$ 100,00 (cem reais). Esse pagamento era feito todos os meses, independentemente do desempenho profissional do trabalhador. Dessa forma, requer que integre a remuneração repercutindo em FGTS, contribuição previdenciária, férias e décimo terceiro salário, assim como componha a base de cálculo das horas extras pleiteadas no presente feito. Requer, ainda, o deferimento da justiça gratuita e a condenação da reclamada em honorários advocatícios (art. 791- A, CLT). Atribuiu à causa o valor de (R$). Juntou documentos. Citada, a reclamada compareceu à audiência. Proposta a conciliação, não foi aceita. A reclamada apresentou contestação por meio eletrônico, aduzindo que não é verídica a alegação de que o obreiro laborava até 14h15min. Para tanto, junta aos autos os cartões de ponto de todo o período contratual. A empresa contesta o pedido de tempo à disposição ao fundamento de que o trabalhador podia se uniformizar em casa. No tocante ao intervalo intrajornada, pugna pela correta concessão de 15 (quinze) minutos a este título, haja vista que a jornada não ultrapassava 6 (seis) horas diárias. Por fim, requer a improcedência do pedido de integração do pagamento feito sob a rubrica “prêmio”, invocando o art. 457, § 2º, da CLT. Impugna o pagamento de honorários advocatícios. Fixados os pontos controvertidos e definido o ônus da prova, consensualmente, procedeu-se à oitiva das partes e de uma testemunha de cada parte. Como declararam que não desejavam produzir outras provas, encerrou-se a instrução. Alegações finais remissivas. Renovada a tentativa de conciliação, não foi aceita. 2 FUNDAMENTAÇÃO

EPP SENTENÇA 1 REPORT The worker Jorge dos Anjos filed a labor claim (case number) against Lanchonete Dois Irmãos LTDA. EPP., Alleging that he was hired on 12/4/2017 and worked until 6/28/2019, his last day of compliance with the previous notice worked.

He claims that he was hired to perform the duties of an attendant, earning monthly remuneration of R $ 1,500.00 (fifteen hundred reais), with a day from 8 am to 1:15 pm, from Monday to Friday.

However, he claims that he extended his journey, on average, 1 (one) hour a day, always ending the day at 2:15 pm, having not received any value for his extraordinary work. He also states that he had to arrive at the defendant 15 (fifteen) minutes in advance to get uniform, a period that was also unpaid.

In view of the length of the day for the overtime provided, that is, for being more than 6 (six) hours a day, he asserts that he was entitled to an intra-day break of 1 (one) hour, but that he was granted only 15 (fifteen) minutes

Finally, the worker points out that he received a monthly installment called "prize", in the amount of R $ 100.00 (one hundred reais). This payment was made every month, regardless of the worker's professional performance. Thus, it requires that it be included in the remuneration, reflecting FGTS, social security contributions, vacations and thirteenth salary, as well as making up the basis for calculating the overtime claimed in this case.

It also requires the granting of free justice and the conviction of the defendant in attorney's fees (art. 791- A, CLT). It attributed the value of (R $) to the cause.
