In a democracy, the democratic rule of law is considered a concept that refers to a state in which there is respect for human rights and fundamental guarantees. There must be a guarantee of individual and collective rights, social rights and political rights.

This means that in order for a State to achieve the objective of being considered a democratic State in law, all citizens' rights must have legal protection and be guaranteed by the State through their governments.
