Through Article I Section 8, Congress can command the military, though the president can as well, but Congress has the the power to raise new divisions and declare war. Another thing, the president can use the armed forces without permission for 90 days.
The United States government functions under the principle of checks and balances. This means that each branch of government has a power that keeps the other branches from becoming too controlling. The branches are separate but equal.
