Government because they are the leaders who command the citizens, and keep order. They also conquer land so their culture can expand area. Governments set the bar it was usually patriarchal, but everyone followed, and if they didn't, they usually would pay a big consequence
It wouldn't be fair but it would be more unfair if the majority lost so it would make more sense to build the fence with less opposition then build something else with the wood with more.
