Juan Manuel de Rosas que había tenido facultades extraordinarias en su primer mandato, asumió por segunda vez como gobernador de Buenos Aires, en 1835, también con una suma de poderes que implicaba el ejercicio de los tres poderes del Estado (Legislativo, Ejecutivo y Judicial). Los hechos que propiciaron su segundo mandato fueron:

  1. La muerte de Facundo Quiroga que provocó un clima de inestabilidad y violencia.
  2. La renuncia de Manuel Vicente Maza en marzo de ese año.

La Legislatura de Buenos Aires convocó a Rosas y le propuso que asumiera la gobernación. Él aceptó pero bajo la condición de que se le otorgase la "suma de poderes".
