Think about it, if you appeal to the supreme court about say a mcdonalds cup of coffee that was too hot and did not have a warning label. (this actually happened and the women got her medical bills paid for by Mcdonalds and got a big lump sum of money) The court would go off of the existing laws in order to prosecute the defendant in the court of law
