The Bassos contracted with Dierberg to purchase her property for $1,310,000. One term of the contract stated, "[t]he sale under

this contract shall be closed . . . at the office of Community Title Company. . . on May 16, 1988 at 10:00 am. . . . Time is of the essence of this contract." After forming the contract, the Bassos assigned their right to purchase Dierberg’s property to Miceli and Slonim Development Corp. At 10:00 am on May 16, 1988, Dierberg appeared at Community Title for closing. No representative of Miceli and Slonim was there, nor did anyone from Miceli and Slonim inform Dierberg that there would be any delay in the closing. At 10:20 am, Dierberg declared the contract null and void because the closing did not take place as agreed, and she left the title company office shortly thereafter. Dierberg had intended to use the purchase money to close another contract to purchase real estate later in the day. At about 10:30 AM, a representative of Miceli and Slonim appeared at Community Title to begin the closing, but the representative did not have the funds for payment until 1 :30 PM. Dierberg refused to return to the title company, stating that Miceli and Slonim had breached the contract by failing to tender payment on time. She had already made alternative arrangements to finance her purchase of other real estate to meet her obligation under that contract. Miceli and Slonim sued Dierberg, claiming that the contract did not require closing exactly at 10:00 AM, but rather some time on the day of May 16. Will they prevail?

Answer:

Certainly, they cannot prevail. The contract terms stated clearly that "time is of the essence of this contract." The Bassos and Miceli and Slonim Development Corp did not actually respect this contract term.

The contract was expected to have closed at 10:00 am on May 16, 1988, and not after. By the time that Dierberg left the venue, the contract should have been finalized. Alternatively, if there were unseen delays, Dierberg should have been informed at least 30 minutes before 10:00 am.

Explanation:

The argument by Miceli and Slonim does not hold water. The contract did require closing exactly at 10:00 AM, and not some time on May 16. In my considered opinion, suing Dierberg is a waste of court time and process.

Zielflug [23.3K]

Answer: V=7.43m/s

d =2.82m

Explanation:

a) For the first part, the initial velocity immediately after ejection, by using momentum conservation

before ejection, the momentum of the squid/water system is zero

there are no external forces acting on the system at the moment of ejection, so we can find the speed of the squid by noting

momentum before ejection = momentum after ejection

0 = M1U + M2V

0=-0.26 kg x 20 m/s + 0.7kg x V

where the speed of the water is taken as the negative sign, and V is the speed of the squid right after ejection, solving for V we get

V=7.43m/s

B. we use the equation vf^²=v0^²+2ad

where vf=final velocity = 0 since velocity is zero at motion's apex

v0=initial velocity = 7.43m/s

a = acceleration = -9.8m/s/s

d=height (to be found)

Therefore,

0=7.43^²+2(-9.8)d

Mathematically, it becomes

d=7.43^²/2(9.8)= 2.82m

d = 2.82m

Answer:

The trade in value is higher than the book value by $ 205

Explanation:

Computation of Book value

In a double declining balance method of depreciation, the rate of depreciation is double the straight line rate and is depreciated on a declining balance.

Cost of Equipment                                                                            $ 37,000

Estimated useful life ( Recovery Period) 5 years

Straight Line Depreciation rate 20 %

Double declining Method depreciation rate 40 %

Cost                                                                                                     $ 37,000

Depreciation for year 1   at 40 %                                                        $(14,800)

Depreciable basis for year 2                                                              $ 22,200

Depreciation for year 2   at40 %                                                       $ ( 8,880)

Depreciable basis for year 3                                                              $  13,320

Depreciation for year 3   at 40 %                                                        $ (5,328)

Depreciable basis for year 4                                                               $   7,992

Depreciation for year 4   at 40 %                                                        $    3,197)

Depreciable basis for year 5                                                                $  4,795

The depreciable basis for year 5 is the net book value after 4 years

The trade value is $ 5,000

The trade in value is higher by $ 205

g If Warren Buffet can beat the market using value investing, then... Group of answer choices the market is semi-strong form eff
vova2212 [387]

Answer: The market is weak form efficient

Explanation:

Weak form markets are markets in which stocks are said to incorporate all past information in their prices. Investors who believe that the market is at weak form efficiency believe that since the stock contains past information, using the current information in the company's books to determine if the company is overvalued or undervalued is possible (fundamental analysis).

Warren Buffet's Value Investing means that he invests in stocks that he believes to be undervalued and sells them for higher or holds them when they appreciate. This is consistent with fundamental analysis. If Warren Buffet is beating the market by investing in undervalued stock then the market is indeed weak form efficient.

Answer:

A general guideline of employment rights

Explanation:

The Consitution of the United States is the base for the entire government as well as the laws of the country.

Bill of Rights

The Consitution has a section commonly referred to as the "bill of rights." This section lists out 10 individual rights that everyone in the country has. Later, this section was amended further to add more rights.

Checks and Balances

Additionally, because the Constitution lays out the format of the government different sections bring up points on how to balance power. For example, Article II, Section 3 allows the president to be impeached if he abuses his power.

Division of Power

The USA follows federalism. This means that there is both a central government and local governments. In the Constitution, rules are in place to ensure that state governments maintain some power. For example, the tenth amendment gives power to the states.

Items Not in the Constitution

The Constitution's primary goal is to create a government and protect basic, individual rights. However, this does not include employment. While there are laws to protect employees and salaries, there are not any in the Constitution.
