Answer: The amendment gives to Congress the power to regulate the labor of children under the age of 18, reserving to the states the right to establish standards higher than those fixed in federal legislation.Representatives of the governors of 44 states, meeting in Washington on February 14 and 15, 1934, at the invitation of Secretary Perkins, advocated adoption of the child labor amendment. The most sweeping federal law that restricts the employment and abuse of child workers is the Fair Labor Standards Act of 1938 (FLSA). Child labor provisions under FLSA are designed to protect the educational opportunities of youth and prohibit their employment in jobs that are detrimental to their health and safety.
