The burden of proof is on the Prosecutor for criminal cases, which makes the defendant believed to be innocent.

When the prosecution holds the burden of proof. They must prove all defenses (not including affirmative defenses) in which the proof of non-existence of all affirmative defense(s), isn't constitutionally required of the prosecution.
