A person might considered Criminally Negligent if they were in a position of responsibility, but due to intoxication cannot fulfill that responsibility properly.
For example, while driving a car, train or a public bus.

This is because, their intoxication can actually cause accidents and even fatal injuries. 

However, if the person is just walking home, or with friends, or is not driving, they will simply be considered intoxicated.
