Lorico [155]

The purpose of the new mandatory discovery provisions is to: remove the element of surprise from litigation. make litigation more of a quest for the truth. minimize discovery times and costs

Explanation:

Discovery refers to the process of exchanging the information between the parties involved in a trial. The prosecution and the defense build their respective cases based on the evidences available. The information exchanged includes

 • Physical evidences
 • Witness statement
 • Police interrogation data
 • List of the witnesses

The biggest change to the Discovery provision is

 • Earlier the defense has to file a written request to obtain the evidences and also no time frame was set to provide the evidences to the defense. So in many cases the prosecutor used to keep the evidences in their custody till the eve of the trial.
 • But as per the new discovery provision, the prosecutor has to provide the defense all the information/evidences within 15 days of the arrangement. The time frame can be extended to 30 days in case the evidence for the trial is large,or the prosecutor does not have evidence in their possession.

Discuss the reliability of the analytical scientist in the quart room.
ValentinkaMS [17]

1)They are very reliable because they are almost always accurate. All science in the courtroom has to be verified in order to be used in the court to prove that their tests are accurate and reliable and can be used as an evidence in court. Reliability is measured by how much your machines have been validated ,if a forensic scientist in a court say the evidence is true but did not have a proper reliability , than people can question how true this test can actually be. Hard science is consisted of chemistry, biology and physics are the most reliable evidence.

2)The reliability of the analytical science in the courtroom is growing. This is because of the fact that analytical science involves comparison between the characteristics and features of the suspected specimens with those obtained from the criminals or victims. The analytical science plays an important role in proving a fact that a crime has been committed, the place of crime and establishing the identity of the culprit.
