The federal government's position in education is, of course, closely related to other aspects of American culture and has its roots in the Constitution. Education is not mentioned in such document. "The powers not delegated to the United States by the Constitution... are reserved to the States respectively," the 10th Amendment states.

This might appear to prevent any federal regulation over education, but the 14th Amendment compels all states to grant "equal protection of the laws to every person within their authority.
