Tony has admired Ann for months, but he has never talked to her. One day, Tony walks up to Ann, much to her horror because she is afraid of him, and gives her a hug and a kiss. tony has committed the tort of battery.

Civil battery is sometimes referred to as the battery as a tort, since it is a wrongful act. A civil battery occurs when a wrongdoer has knowledge that their action may harm another person but yet hurts that person without intending to do so. Even though civil battery does not involve the desire to cause harm, battery is regarded as an intentional tort. Hence, the victim may file a civil court suit against the wrongdoer.

Battery must involve physical contact or the application of force. Although using force to cause harm is not a fundamental requirement, conducting battery operations does require it. Physical contact through indirect means is also seen as physical touch; it is not necessary for it to be direct or personal. Changing the heat, odor or light and harming people is also referred to as a battery.
