Carla collects unique pens. In class, she notices that her friend Andrew is using a rare fountain pen that she wants to add to h

er collection. At the end of class, Carla pretends that her pen has run out of ink and asks Andrew if she can have the fountain pen to write her name on her paper before passing it in to the professor. It was not a gift, because Andrew intended to allow Carla to use the pen, not to transfer ownership to her

Explanation:

The pen handed over to Carla by Andrew was not intended by Andrew to be a gift. this means that Carla cannot claim ownership of the fountain pen since Andrew the original owner did not transfer ownership to her and merely gave lent her the pen to write her name and then give it back to him. Andrew can therefore get his pen back if he wishes.

Andrew did not gift the pen to Carla. He only lent it out to her.

Explanation:

Sometimes in order to acquire things we do things that are silly and somewhat funny. This is the same case with Carla in the question above. Carla loves unique pen and seeing one with Andrew she thought of a way for the pen to be hers and devised that way.

That was not right for her to do. She could have asked Andrew to gift the pen to her or ask her parents or caretaker to get something of such for her.

Andrew has all the right to collect back his pen, because he never did give Carla the pen as a gift in the first place.
