In the case of Malcom Accident;

Given that;

Malcom was judged 20% at fault for the accident = 0.2

The other party was judged 80% = 0.8

The cost of treatment for Malcolm's actual damages were $40,000

∴

Malcom share of the cost he is responsible to pay for his treatment = 0.2 × $40,000 = $8,000.00

The share of cost he is responsible to receive from the other party = 0.8 × $40,000 = $32,000.00

∴ Under a pure comparative negligence rule, much would Malcolm receive $32,000.00 for his injuries.
