Explanation:

In order for the new law to be constitutional, it would need to pass several criteria to ensure that the state is not over playing it's hand.

It should be proven that the law is furthering the interest of a state goal which in this case is to create a more aesthetically pleasing environment that is not offensive to to citizens.

To prove that and also to prove that the state is not overplaying it's hand and abusing it's power, all the above options need to be looked at.
