The Constitution of the United States established three branches of government, namely; The Executive, Judiciary, and Legislative branch. The Checks and Balance system was created to reduce the excess of each branch of government and to bring about a proper and smooth running of affairs. Checks and balances are used to avoid the centralization of power in one tier of government. Although there is a separation of powers and independence of the Judiciary, there is a need to Check and balance these powers.

The Legislative branch also is known as Congress is endowed with the function of law-making and this power is subject to the approval or veto power of the Executive branch of government. The legislature can, however, in return, vote to surpass the veto power. The laws made by Congress can be pronounced unconstitutional by the Judiciary.
