When a civil rights law was challenged after the Civil War, the Supreme Court ruled in favor of discrimination against African Americans because it was not slavery.

In 1896, in the case Plessy v. Ferguson, the Supreme Court ruled that the racial segregation was constitutional. "Separate but equal", they said. It wasn't slavery, but it was still a huge setback for Civil Rights in the US.
