Formal justice systems involve mechanical/procedural steps for all criminal defendants which guides their passage through the Criminal justice system - arrest to punishment. Informal justice systems on the other hand involve the interaction and active removal of criminal defendants proceeding through the Criminal justice system and justified via the use of discretion by authorized individuals involved in the system.

Formal justice systems treat all eligible citizens with the same procedures and rules, while informal justice systems act arbitrarily. Many think informal systems are unfair because they also emotion to play a role in the justice.
