After the Civil War, the 13th Amendment and 14th Amendment effectively overturned the Dred Scott decision.

In 1852, the Missouri Supreme Court struck down the lower court ruling, arguing that, because of growing antislavery sentiment in the free states, Missouri no longer had to defer to the laws of free states. By this decision, the court overturned 28 years of precedent in Missouri.

The 14th Amendment to the U.S. Constitution, ratified in 1868, granted citizenship to all persons born or naturalized in the United States—including former slaves—and guaranteed all citizens “equal protection of the laws.” One of three amendments passed during the Reconstruction era to abolish slavery .
