The Southern Manifesto was a statement of opposition against the Brown v. Board of Education of Topeka, Kansas which desegregate

d schools. It wanted the schools segregated and its argument was that nowhere in the US constitution does it mention education and this was an abuse of judicial power. My question is can you link their argument to any other situations in US history?

Perhaps in the Civil War era, the Dred Scott decision angered Abolitionists as the Supreme Court declared African Americans could not be a US citizen as they were not mentioned as as in the Constitution and that Congress abused their power by abolishing Slavery above the Mason Dixon line and in the New Western territories.
