The Mandate of Heaven was created under the Zhou Dynasty. According to the Mandate of Heaven, China could only have one ruler at a time. The one ruler was considered to be the 'son of Heaven' and he was made the ruler with approval of Gods.

If a rule was not fair in his duties, then it was considered that God might have taken back His approval. Also, conditions like famine and natural disasters were considered that the Gods were unhappy with the ruler.

Or else he will leave as an innocent.

As before the fifth amendment was proposed and after it accepted to be included as a part of the constitution, there were some cases which were dealt in a very unfair way so, many of accusations were just baseless and with out having any trial for any accused, the system was able to term him as a criminal. As it was an ill treatment of the accused which led many to serve jail and more punishment in the early years.
