The answer is the driver. A passenger with 17 years of age or younger can’t be charged.

 

EXPLANATION

It is the driver’s responsibility to make sure that the passengers wear a seat belt it’s available. If the passenger is 17 years old or younger, then the driver will be fined for seat belt violation. If the passenger is 18 years old or older, then the passenger will be fined for her/his wrongdoing.  

 

In-seat belt violation, there are two kinds of enforcement, which are secondary enforcement and primary enforcement. In primary enforcement, a police officer is allowed to stop and ticket a driver if he/she are seen violating. Where in secondary enforcement, the driver committed a primary violation such as running a stop sign and speeding, and the police officer can also find the driver with seat belt violation. In the United States, each state is required to use a seat belt while driving. The only US state that does not apply a law to wear seat belts while driving a motor vehicle in New Hampshire.

 

15 out of 50 states consider law about seat belt as a secondary offense, which means that the police can’t ticket a driver only for not wearing a seat belt. The driver needs to commit the primary violation, and then be additionally charged for not wearing a seat belt.
