Nuisance is the wrongful interference with the right to the quiet use and enjoyment of land. 

There are two types of tort in nuisance.

1) Private Nuisance - where the action of the defendant causes substantial and unreasonable interference of the claimant's land affecting his enjoyment or use of said land.
 
2) Public Nuisance - where the action of the defendant negatively affects the comfort and convenience of life of the social class belonging as the queen's subjects.

It is important to note that what Mr. Rodr was doing was in the interest of his employer and he was still an employee when the incident happened.

These 2 facts alone entitle him to workers compensation benefits.
