How can individual rights and the common good come into conflict?

Individual rights may conflict with common good when a person does something that hurts other people’s rights. Because of that, the Constitution does not guarantee absolute individual rights because absolute rights may hurt other people’s rights.

For example, people have the right to smoke, but they are banned from smoking in public buildings because it hurts nonsmokers rights.

Individual rights may obstruct justice in some ways by permitting a person to bargain for a crime committed. This may not be good for the common good.

Hammurabi's Code set laws in the Babylonian empire that applied to everyone. Including Hammurabi himself. This was important because it had never been done before, at least not at such a bit level. Hammurabi's Code inspired many countries to do the same, which led to monarchs being less powerful and was another step in the direction of democracy.

Assuming that you're referring to the Unsigned Southern Press review of 1852, i think the writer was using first person point of view plural.
In the review, the writer keep using the word 'we' such in : "we doubt Mrs. stowe would recognize the cogency of this argument"
