The Background of the case was that Benjamin Gitlow was convicted of violating the New York Criminal Anarchy Act that prohibited speaking, teaching, advising, printing, publishing any doctrine that believed that the government should be thrown by force or violence.

The US Supreme Court decided to uphold Gitlow’s conviction because did not saw the present danger of an attempt to overthrow the government and that the State was not required to prove in each case that there was any particular danger in that speech.

Hirohito inherited the throne, becoming Emperor in 1926. In 1926, Japan was already a powerful war machine. Having defeated China in 1894, Russia in 1905, and was an allied power against Germany during WWI (1914-1918).
