La diferencia principal entre el diferencia el estado moderno, de las formas de estado que existían en la Edad Antigua y en la Edad Media es la siguiente.

El estado moderno es un Estado de Derecho, lo que significa que surge y está regulado por una serie de leyes que conforman una Constitución en donde se establecen los derechos y obligaciones de las personas en un  país.

EL Estado de Derecho permite a los ciudadanos de gozar de libertades constitucionales, garantizadas por la ley. Todo lo contrario a las formas de gobierno antiguas o de la Edad Media, en donde el Rey imponía su caprichosa voluntad al pueblo, lo humillaba y lo explotaba.
