In a common law system, the higher court has the full authority to decide how a certain case should be handled without the involvement of the citizens.

In civil law, the citizens play a huge role in the judiciary system.  Both criminal and civil cases in a civil law system can be brought to the public court where the citizens can act as 'juries' that will vote for the outcome of the case. The judge in this process only had the obligation to apply the decision made by the juries.
