The Commerce Clause serves a two-fold purpose: it is the direct source of the most important powers that the Federal Government exercises in peacetime, and, except for the due process and equal protection clauses of the Fourteenth Amendment, it is the most important limitation imposed by the Constitution on the exercise of state power. The latter, restrictive operation of the clause was long the more important one from the point of view of the constitutional lawyer. Of the approximately 1400 cases that reached the Supreme Court under the clause prior to 1900, the overwhelming proportion stemmed from state legislation.663 The result was that, generally, the guiding lines in construction of the clause were initially laid down in the context of curbing state power rather than in that of its operation as a source of national power. The consequence of this historical progression was that the word “commerce” came to dominate the clause while the word “regulate” remained in the background. The so-called “constitutional revolution” of the 1930s, however, brought the latter word to its present prominence.

The two major Supreme Court Cases were Plessy vs. Fergussion and Brown vs. Board of Education. Each are extremely important cases not only to African Americanś but United States citizens as a whole because it affected everyone. Plessy vs. Fergussion was a case that later would be overruled with another case but the final rulling of this specific case was that Äfrican Americans were ¨segregated but equal¨. Also, Brown vs. Board of Education over rulled the previous rulling and allowed students who were black to attend school and not be segregated. Overall, the rulling are important to the Fourteenth Amendment because they both dealt with equal rights for minorities.

American Indians had their own culture and philosophy. This understanding of the world as widely misunderstood by European settlers, who always saw Native Americans as an obstacle, or even menace to their expansionary interests.

Indians quickly understood the European settlers interests and in many cases adopted a stiff opposition and conflictive attitude towards them. This would eventually lead to memorable incidents, such as the Wounded Knee Massacre, where the US army killed numerous Indians due to a misunderstanding that escalated into a fight.

There was a clear lack of understanding between both parts and both of them have a degree of responsibility for it.
