Law

The positivist thesis does not say that law’s merits are unintelligible, unimportant, or peripheral to the philosophy of law. It says that they do not determine whether laws or legal systems exist. Whether a society has a legal system depends on the presence of certain structures of governance, not on the extent to which it satisfies ideals of justice, democracy, or the rule of law. What laws are in force in that system depends on what social standards its officials recognize as authoritative; for example, legislative enactments, judicial decisions, or social customs. The fact that a policy would be just, wise, efficient, or prudent is never sufficient reason for thinking that it is actually the law, and the fact that it is unjust, unwise, inefficient or imprudent is never sufficient reason for doubting it. According to positivism, law is a matter of what has been posited (ordered, decided, practiced, tolerated, etc.). Austin thought the thesis “simple and glaring”. While it is probably the dominant view among analytically inclined philosophers of law, it is also the subject of competing interpretations together with persistent criticisms and misunderstandings.

What is the Point system ?

 • Courts and state motor vehicle licensing agencies use the points system as a tool to punish offenders who repeatedly commit the same traffic infractions.
 • Although not all states use it, this system first became popular in the US in the 1970s.
 • Points make it easier for law enforcement to spot repeat offenders and discourage motorists from committing the same crime in the future.
 • Having points assessed to your license can have serious and unpleasant repercussions, including:
 1. Increased expenses for car insurance
 2. A license that is revoked or suspended

Law is a practical discipline. Theory has no place in law. Discuss with references to Law of contract
Sholpan [36]

Answer:

The law does not allow the interpretation of a given situation, but gives a specific and practical answer to what is happening. For this reason, we can say that law is a practical discipline. Theory has no place in law.

Explanation:

A theory is something that was created according to someone's interpretation of a given situation. There is no certainty in the theory, it can be contested and redefined whenever someone finds it necessary. For this reason, there is no room for theory in the law.

The law is objective, clear and direct, there is no dispute, nor different interpretations, the law cannot be tested, that is, the law is something direct and specific that results in a single and correct answer about a situation.
