i understand that People are engaged in making certain products or goods in the production-oriented profession whereas people use their skills and knowledge for serving the people and the society in the service-oriented profession. For example, vegetable farming, knitting, weaving, etc.

The fifth amendment protects the following rights of each Citizen in the US.As it made it very easy for the system, as well for all the individuals to deal with the criminal trials and protection of ones possession inside the US.

  1. Not to punish any person twice on the bases of the same charges filed against them before or for the same offence made by the criminal(A prohibition on double jeopardy).
  2. As no one can be termed as criminal before he or she faces the grand jury or the court (Right to indictment by the grand jury before any criminal charges for felonious crimes).
  3. While a person is under trial he can't be forced to provide any evidence to help the system to prosecute the same person in a any case, as he can willingly provide some material or evidence only upon his will(A right against forced self-incrimination).
  4. Each individual who is facing some legal issues and is faced by the court or the system inside the US will be granted the right to go through a procedure of trial.As no one can be termed as criminal unless there are any number of true evidence or proofs been presented in the court(A guarantee that all criminal defendants have a fair trial).
  5. The System or The Government of the United States can't confiscate any citizen's property or land (possession of that individual), without the well of that individual. It can only be able to do so after both the parties agree on a set of terms. As the government is required to pay the required amount of money as per the market ( a guarantee that government cannot seize private property without making a due compensation at the market value of the property).

Logically it is also very unfair and inhumane to term any individual as a criminal with out having any trial set for that person. As a person can be punished or termed as a criminal by the system on proving the charges filed against him or her. As the individual will be required pass from a series of trials, after which if proved guilty by the grand jury and the court, he will be punished or simply jailed. Or else he will leave as an innocent.  

  • As before the fifth amendment was proposed and after it accepted to be included as a part of the constitution, there were some cases which were dealt in a very unfair way so, many of accusations were just baseless and with out having any trial for any accused, the system was able to term him as a criminal. As it was an ill treatment of the accused which led many to serve jail and more punishment in the early years.
