Answer:

The four primary functions of law – preventing undesirable behaviour and securing desirable behaviour which is performed in criminal law and torts; providing facilities for private arrangements between individuals, which is found in private law, criminal, and tort law; provisions of services and the redistribution of goods found in legal systems; and settling unregulated disputes found in courts and tribunals – are discussed in the chapter. It also tackles the secondary and indirect functions of the law. The secondary functions of the law include the determination of procedures for changing the law and the regulation of the operation of law-applying organs. The chapter concludes with the discussion of H.L.A. Hart's classification of law. Laws provide a framework and rules to help resolve disputes between individuals. Laws create a system where individuals can bring their disputes before an impartial fact-finder, such as a judge or jury. Definition and Regulation of Social Relationships. Identification and Allocation of Official Authority. Dispute Settlement and Remedies. Change of Law.

Which part of the declaration of independence acts as an implied plan of action
svetlana [45]

Answer:

the body

Explanation:

The Declaration of Independence is the document referring to the time when the US was founded, we can consider this document as the founding document of the country, as through it the country can completely detach itself from British rule. This statement was approved by the Continental Congress on July 4, 1776, and has in its text the genius of Thomas Jefferson.

Regarding the structural declaration of independence, we can state that the body of the declaration acts as an implicit plan of action, since the laws and practices discussed therein were written in a proposition but not formally expressed; not manifestly stated and subject to change.

nadya68 [22]

Answer:

b) the establishment clause.

Explanation:

The provisions of First Amendment's Establishment Clause restricts the government from establishing any laws pertaining to religion. It does not allow the government to take actions in favor of any particular religion nor does it promote any kind of governmental preference of a particular religion over another religion.

It maintains that government should restrain itself from mediating into religious affairs and its decisions should not be based on religious grounds. Though this provisions clearly advocates governments to remain in distance from religion, there have been several violations in the past.

Here, the government of Oklahoma enacting a law requiring all businesses in the state to donate 10 percent of their profits to Protestant churches is a clear violation of the Establishment Clause.
