The judicial branch is appointed by the executive branch for life and is therefore no longer under the control of the executive branch after appointment. The courts can then check the actions of the executive branch through judicial review to determine if their actions are constitutional or not. Therefore, the judicial branch has the ability to check the executive by upholding the American Constitution.
