Diversion involves systemic efforts to remove individuals from further processing in criminal justice by placing them in alternative programs: "diversion may be pretrial or post trial.".

What is Criminal justice?

Criminal justice is the process by which offenders are apprehended, tried, and sentenced based on their crimes. Law enforcement, the judicial system, and correctional facilities make up the majority of the criminal justice system.

The diversion in criminal justice is given as-

 • A diversion is a different course of action in a criminal case where the prosecution is stopped by an agreement between the defendant and the prosecutor, in which the prosecutor either drops all charges or doesn't even file any at all.
 • If the defendant successfully completes a rehabilitation program and a period of probation, they are given the opportunity to avoid having a criminal conviction appear on their record.

The different factors to determine whether the defendant qualifies for a diversion. Such factors include:

 1. the offender's capacity for rehabilitation,
 2. the circumstances of the offense,
 3. the offender's criminal history,
 4. the offender's socioeconomic background,
 5. the offender's mental and physical health,
 6. and the value of deterrence to the offender and society as a whole.
