Would violation of this law be criminal or civil ? Please don't answer if you're unsure!

I believe the correct answer is a civil offense. 

"This bill would allow such acts to be considered a misdemeanor offense.
misdemeanor means a minor offense, so it wouldn't be criminal.

criminal offense is "any offense with malicious intent (motivated my hatred)"
