One Saturday Sam decides to burn off some old tree limbs and other landscaping debris at his home. He fails to consider how dry

it is and how hard the wind is blowing and the fire spreads ultimately destroying his neighbors shed. Was Sam negligent?

Any conduct short of intentional or reckless action that falls below legal standard for preventing unreasonable injury. It is the failure to exercise a standard of car that a reasonable person would have in a similar situation. For example, a driver who runs a stop sign causing an injury crash.

From the definitions above, it can be deduced that Sam was negligent because, He fails to consider how dry it is and how hard the wind is blowing thereby causing a fire that destroys properties of his neighbors.
