From the power to regulate commerce the Congress derived the authority to stop a tax on Internet sales.

Explanation:

In the United States of America under the constitution in Article I, Section 8; that endorse the powers to congress to regulate commerce and that is called the commerce power.

The US congress has the authority to control the commerce in foreign trade, trade happening between the states and the trade happens within the Native American tribes.

The congress will lay down rules and regulations for bringing a consolidation in trade and business which is called as commerce. The main aim of the commerce regulation is to keep the foreign goods at check.

Anyone else sick of these mask? (please no hate i'm just wonder and I do follow the rules)
EastWind [94]

Answer:

Yes, but you have to follow them even if you don't have a weak immune system.

Explanation:

Many people don't wear masks which makes the chances of getting Corona increase dramatically. However, if you are wearing a mask, your chances shouldn't be that high since you have some protection, just make sure it covers your mouth and nose. I am so tired of wearing them though and sometimes I forget to take it off.

Answer:

Federal District Court

Explanation:

The first case would likely start in the Federal District Court and could be appealed to the State Supreme Court and United States Supreme Court. As seen in Mahanoy Area School District v. B.L. the school district which suspended a girl for vulgar speech off school grounds started their case in the federal court of Middle District of Pennsylvania and eventually appealed all the way to the Supreme Court.

Edit: Mahanoy Area School District v. B.L. did not appeal to the State Supreme Court likely because the First Amendment is a federal law and not state law.

If you were a member of the Supreme Court what law would you rule as unconstitutional? What basis would you use to support your
Vsevolod [243]

Answer:

Explanation:

The def: not in accordance with a political constitution, especially the US Constitution, or with procedural rules. Ex." we cannot tolerate unconstitutional action" Declaring laws constitutional or un unconstitutional is done by the deciding in the Judicial Branch of government.

However, governments do not just create laws. Governments also enforce the laws set forth in the document defining the government—in the Constitution. In the United States, the failure to seat duly elected representatives of the people following a proper election, or the failure to provide for such elections would be unconstitutional even in the absence of any legislated laws whatsoever.

When the proper court determines that a legislative act (a law) conflicts with the constitution, it finds that law unconstitutional and declares it void in whole or in part. This is called judicial review. The portion of the law declared void is considered struck down, or the entire statute is considered struck from the statute books.

Depending on the type of legal system, a statute may be declared unconstitutional by any court, or only by special Constitutional courts with authority to rule on the validity of a statute. In some countries, the legislature may create any law for any purpose, and there is no provision for courts to declare a law unconstitutional. This can occur either because the country has no codified constitution that laws must conform to (e.g., the United Kingdom and New Zealand) or because the constitution is codified but no court has the authority to strike down laws on the basis of it (e.g., the Netherlands and Switzerland).
