Probable clause is found in the fourth amendment of the US constitution. It is present if the police has a resealable belief in the guilt of a suspect based on the information and fact prior to the arrest.
Courts invoke the probable clause when there is sufficient reason to believe that a crime may have been committed and for conducting searches. Under exigent circumstances this clause can also justify warrant less seizure and search. If a person is arrested without a warrant it is required to bring him before the competent authority for judicial determination of probable clause.
