My reaction to this idea is the following. By searching the definition of lex talionis, we find that it is a principle that says, that when we (as individuals) must decide a punishment for someone who acted the wrong way on a certain circumnstance, said punishment should be thought about and applied according to the degree and kind of mistake any other persons had made. So, taking into account the etymology of the definition, I believe that what is established in this task is not correct. Lex talionis it is, in fact, prescriptive rather than proscriptive.
