In the majority of the cases is the Judge, not the Jury who determine the sentence for a convicted criminal defendant. The sentence is provided by a statute.
But in the particular cases of capital punishment, in the vast majority of the States the Judge had no power to impose that type of punishment. It is up to the Jury to determine faith of the convicted criminal.
