In a 5-3 vote in favor of Mapp, the US Supreme Court ruled. The high court said that unlawfully seized evidence can not be used in criminal proceedings in state courts without an investigative warrant.

N An opinion written by Justice Tom C. Clark brushed aside First Amendment issues and ruled that, in a State Court in contravention of the Fourth Amendment, all evidence gathered from the searches and seizures were inadmissible. The decision launched the Court in a difficult way in which the exclusionary rule was enforced.

The Black and Douglas judges agreed.

In the judgment, Justice Stewart agreed but fully agreed with the disagreement of Part I of Justice Harlan, expressing no opinion on the merits of the constitutional question.

In conjunction with Justices Frankfurter and Whittaker, Justice Harlan wrote a disagreement.
