Based on the 1981 U.S. Supreme Court decision in Plyler v. Doe, all states are required to provide K-12 education for undocumented immigrants and their children. This case was due to the revisions to education laws in Texas in 1975 for educating illegally immigrated children to the United States.
Plyler V. Doe was a benchmark case in the history of the United States. In this particular case, the U.S. Supreme Court struck down both state law and municipal schools districts attempt to charge a high amount of tuition fee from the students. In this case, the state law denied providing fund for education for those students who had migrated to the United States, undocumented. At the same time, the municipal school district began charging $1,000 as an annual tuition fee to counterbalance for the loss of the state funding.
