Yes he will be allowed in light of the fact that the two claims would be founded on two different theories of action.  

A lawsuit is a procedure by a gathering or gatherings against another in the civil court. Once in a while, the expression “lawsuit" is in reference to a civil activity brought in a courtroom in which an offended party, a gathering who professes to have brought about misfortune because of a litigant's activities, demands a legitimate or equitable remedy.
