Mary Sabo suffered injuries in an automobile accident caused by Daniel Hoag, an intoxicated driver. Hoag had just left Peoples

Restaurant after having consumed a large number of drinks. Sabo sued Peoples for damages, alleging that the restaurant had violated a state statute that provided that any person who “knowingly serves” an individual who is “habitually addicted” to alcohol may be held liable for any injuries or damages caused by the intoxication of that individual. In spite of evidence indicating that for the two years prior to the accident, Hoag had gone to Peoples twice a week and on each occasion had drunk liquor until he was intoxicated, the trial court granted Peoples’ motion for summary judgment. The court held that Sabo had failed to show that Peoples had knowledge that Hoag was an alcoholic and the bar had therefore not “knowingly” served an alcohol addict. Was summary judgment for Peoples appropriate in this case?

I think the summary judgement would be inappropriate in this case

Summary judgement is entered by the court if the plaintiff does not have sufficient evidence that the defendants actually do what they're accused of before moving to trial.

On this case, There is a strong proof that peoples restaurant is aware of Hoag's alcoholism : intoxicated

This mean that sabo can proof that the bar know hoag is an alcoholic and had served enough amount to hoag to get him intoxicated.

This mean that Sabo's case is strong enough to be brought to the trial. keep in mind that Sabo is unlikely to win the trial since the restaurant does not directly involved in the accident. but we can definitely say that summary judgement would be inappropriate in this case.

mel-nik [20]

The Federal Reserve Act of 2000 says that the Fed "shall maintain long run growth of the monetary and credit aggregates commensurate with the economy's long run potential to increase production.

Explanation:

The Act was created in 1913 and signed by the then ruling president as a way of establishing economic stability. This act introduced the central bank to oversee the state monetary policies. The law was established to set out the structure, purpose and function of the Reserve System.

Due to recession and other financial crisis prior to 1913, investors lacked trust in bank systems, therefore the act was passed to bridge the gap between citizens and the banking system. Over the years it has been amended by Congress to keep up with the changing financial times.

How does a climate pattern of the western United states the reflect occurrence of the rain shadow effect
tatiyna

Explanation and answer:

A rain shadow is a patch of land that has been forced to become a desert because mountain ranges blocked all plant-growing, rainy weather. On one side of the mountain, wet weather systems drop rain and snow. On the other side of the mountain—the rain shadow side—all that precipitation is blocked.

In a rain shadow, it’s warm and dry. On the other side of the mountain, it’s wet and cool. Why is there a difference? When an air mass moves from a low elevation to a high elevation, it expands and cools. This cool air cannot hold moisture as well as warm air. Cool air forms clouds, which drop rain and snow, as it rises up a mountain. After the air mass crosses over the peak of the mountain and starts down the other side, the air warms up and the clouds dissipate. That means there is less rainfall.

You’ll often find rain shadows next to some of the world’s most famous mountain ranges. Death Valley, a desert in the U.S. states of California and Nevada, is so hot and dry because it is in the rain shadow of the Sierra Nevada mountain range. The Tibetan Plateau, a rain shadow in Tibet, China, and India has the enormous Himalaya mountain range to thank for its dry climate.

When a minor falsely advises the other party that he is of the age of majority and based upon that misrepresentation, the other
melamori03 [73]

Answer:

Following are the solution to the given question:

Explanation:

In a mistaken declaration by a child of his age and depending on such misrepresentation, another party engages with a child in good faith. There is no unitary norm. States vary, but any of the above may be valid, based on the jurisdiction.

But you're not bound by the contract whether you have accepted and are under 18 (In the U.S.). If they are brought to court, they will win because a minor cannot agree under 18. Even when a minor is about maturity in the contract, a contract is void.
