1. This is a matter of CRIMINAL LAW.
The driver in the scenario given above have broken a law which was expressly given to monitor the speed of the drivers who use that road and he had thus committed a crime. A criminal law is a body of law which deals with crimes. Criminal law proscribes conducts which are perceived as endangering to the safety of people.
2. The source of the law is a statue.
A statue refers to an act of legislature which proscribes or declare a specific law, which is expressed in writing . Statues normally set out the general proposition of a law.
3. The law was enacted to protect the safety of the people. The law by putting a limit on the speed of the motorists that used the road seek to reduce or possibly eliminate auto accidents on the road. If the law did not exist, people will have the opportunity to drive at any speed they like and this can be very dangerous as this will drastically increase the number of people that get involve and possibly die from motor accidents.
4. The father did not have a valid argument, because from his statement it is obvious that he was speeding intentionally. In the process of speeding in order to get to the hospital on time, he might have an accident and killed the wife and the unborn baby in her stomach.
It will not be a good idea for government to make exception to this law, because people will always take advantage of the loopholes created by exception. In the case of medical emergency, it will be best to call the hospital ambulance. This is because, the other road users will give the ambulance the right of way and the paramedics will also be attending to the patient before they get the person to the hospital.
