A person is called an accused person because according to law, he is presumed innocent until proven guilty.

Depending on different jurisdictions, the jury is usually selected by way of summons. After this, Counsel on both sides (Prosecution and defense counsel) will begin with an opening speech by briefly summarizing the facts of the case, arguments they wish to canvass and the evidence that will be adduced to prove the case.

Furthermore, Examination-in-chief, Cross-examination, and Re-examination of witnesses on both sides will begin. After this, the case will be given to the jury to decide the case on its merits.
