Answer: One could correctly argue that it is a violation because the states have different populations and should have proportional votes.

Explanation:

Popular sovereignty is a concept based on the idea that government is meant to benefit its citizens, and states that the only source of governmental power is the people.

It´s reasonable to say that each State having one vote is a breach in popular sovereignty as the states´populations differ and ought to have equal representation regardless.

The popular sovereignty principle would later become a main idea of the United States Constitution.

In McCullough v. Maryland (1891), the US Congress defined the scope of legislative power. During this monumental case, the Supreme Court found that Congress had “implied powers” (powers not expressly listed in the Constitution) and that the Necessary and Proper Clause gave them the power to establish a National Bank.


President Jackson did not agree because he felt the finding was unconstitutional and had the ability to greatly overpower the federal government. Jackson vetoed the bill refusing to acknowledge warnings that doing so would threaten his re-election chances.
