Statutory will differs with each city or county but I believe this should answer your question.
Statutory Will is made for a person(or people) by a Court in situations where the person does not have the mental capacity to make the will for themselves or do not have the capacity to understand all that is necessary to making a Will.
There is no crime of homicide. Walt had no motive for killing the jogger and this was clearly an accident. Not even reckless driving. Walt stops to help. That's all we know. Did he then leave the scene? That would be a crime. Based on what we're told, there is no homicide. No intent to kill the jogger.
