How to prove provocation in Crimes

Law
1 answer:
USPshnik [31]2 years ago

Answer:

Provocation is often a mitigating factor in sentencing. It rarely serves as a legal defense, meaning it does not stop the defendant from being guilty of the crime. It may however, lead to a lesser punishment. In some common law legal systems, provocation is a "partial defense" for murder charges, which can result in the offense being classified as the lesser offense of manslaughter, specifically voluntary manslaughter.

How has the sentence for felony murder for minors changed over time?
Nadusha1986 [10]

Answer:

ust about anyone who sat through ninth grade Civics class can tell you that the Eighth Amendment to the Constitution of the United States prohibits cruel and unusual punishment.  But what exactly is cruel and unusual in contemporary American society?  Public executions have been outlawed since 1936. No one has been executed by hanging or firing squad since 1996 (with the exception of Ronnie Lee Gardner, who was famously executed in 2010–despite a 2004 mandate by the Utah legislature to halt firing squad executions–because of his choice to be “grandfathered” under the old system[1]), and, with a few exceptions, the comparatively humane method of lethal injection is widely used in the thirty-four states in which the death penalty has not been abolished.[2]

On Monday, Travis took his four-wheeler to Reppart's Equipment & Service for repair because the steering was not working pro
kumpel [21]

Answer:

The service repair company advised Travis of the issues with the steering problems.  He disregarded the notice and decided to drive the four wheeler before fixing the issue.  Therefore, Travis assumed all responsibility after knowingly driving the four wheeler after being told of its issues.  The people who he hit and caused damaged or injury to would clearly  have a case against him.  Perhaps even if he wasn't aware of the problems and caused damage to their persons or property, he would still be at fault. However, in that situation, he would likely be able to go after the service repair shop showing negligence on their part for failure to disclose this information.
